I register as vendor which will further be known as the first party in this agreement and Smart Mechanical Engineers Office Plot No.  – 39 Toshika Vihar Colony Ajmer Road Data Tehsil Rajasthan Pin Code 305025 which will be further known and recognized as second party in this agreement has been executed between.

 That the second party is the owner of Smart Mechanical Engineers who provide the service of two-wheeler in India and the first party does the work of repairing the above two-willer service and the first party is willing to work in the service of the second-party two-willer, so this agreement is as follows:  attested to the condition

1. That the second party will try to provide the first party to the two-wheeler / bike from 1 to 2000, if he is unable to do so, then the first party cannot do any kind of debate and any legal action against the second party.
2. That the first party will check and follow all the 22 rules mentioned in the second party’s Brochure in every service.
3. That the first party will make an appointment to the customer every day from 9 am to 3 pm and that the first party will complete all the work on time to the second party’s brochure holder.  And at the same time will receive the entire amount from the customer.
4. That the first party will not refuse service to any customer of the second party (Smart Mechanical Engineers) and will provide them good and advanced on-wheeler service as per the brochure.  That is the amount indicated in the brochure from the first party customer.  Accordingly, 50% of the service amount (250÷2= 125 Rs.) will be taken and 50% of Engine Flush (190÷2= 95 Rs.) and 50% of Engine Audit (175÷2= 87 Rs.) and Petrol Supplements.  Will take 50% (185÷2=92 Rs.) amount in addition will not charge the amount from the customer
5. That the first party will provide a discount of Rs.50/- to the second-party customer for 12 times service on labour costing more than Rs.200/-.
6. That the First Party will not share or make aware of any information and activities of the Second Party to any person or customer.

• That the first party will not do any kind of betrayal with the second party and with the customers and will not misbehave in any way with the customer.
• That the second party customers will not be restricted for any service from the first party. Customers can bring the goods as per their wish and get the service done from the first party.
• That the customer’s bike service will be guaranteed by the first party for 10 days and in case of any problem, the first party will correct it again.
• That the first party does not want to work with the second party, will inform the second party in writing 1 month in advance and will provide regular service for 18 months to the customers of the second party whose brochures have been issued and any complaint of any customer of the second party.  Then the second party will have the right to terminate the work immediately without notice.
• That in this agreement no amount has been provided by the second party to the first party, so the first party will not in any way create pressure and debate on the second party to get the amount.
• That the jurisdiction of all the disputes will be Nasirabad, which will be decided by the consent of Smart Mechanical Engineers.

मैं विक्रेता के रूप में पंजीकरण करता हूं जिसे आगे इस समझौते में प्रथम पक्ष के रूप में जाना जाएगा और स्मार्ट मैकेनिकल इंजीनियर्स कार्यालय प्लॉट नंबर – 39 तोशिका विहार कॉलोनी अजमेर रोड डेटा तहसील राजस्थान पिन कोड 305025 जिसे इस समझौते में दूसरे पक्ष के रूप में आगे जाना और पहचाना जाएगा के बीच निष्पादित किया गया है।

       कि द्वितीयपक्ष स्मार्ट मेकॅनिकल इजिनियर्स की मालिक है जो टू विलर की सर्विस भारत वर्ष में उपलब्ध करवाती है तथा प्रथमपक्ष उक्त टू – विलर सर्विस रिपेयरिंग का काम करता है तथा प्रथमपक्ष द्वितीयपक्ष की टू – विलर की सर्विस में काम करने का इच्छुक है अतः यह इकरारनामा निम्नांकित शर्त पर साक्ष्यकित किया गया है

1. कि द्वितीयपक्ष प्रथमपक्ष को 1 से 2000 तक टू – विलर / बाईक उपलब्ध कराने का प्रयास करेगा अगर वह इसमें असमर्थ रहता है तो प्रथमपक्ष द्वितीयपक्ष के विरूद्व किसी भी प्रकार का वाद – विवाद एवं कोई भी कानूनी कार्यवाही नहीं कर सकता है ।
2. यह कि द्वितीयपक्षा के बॉसर में बताये गये सभी 22 नियमो का प्रथमपक्ष हर सर्विस में चेक करेगा व उसका पालन करेगा ।
3. कि प्रथमपक्ष प्रत्येक दिन सुबह 9 बजे से 3 बजे तक ग्राहक को अपॉइंटमेंट देगा तथा प्रथमपक्ष द्वितीयपक्ष के ब्रोसर धारक को समस्त काम समय पर पूरा करके देगा । और उसी समय पर संपूर्ण राशि ग्राहक से प्राप्त करेगा | 
4.  कि प्रथमपक्ष द्वितीयपक्ष ( स्मार्ट मेकेनिकल इजिनियर्स ) के किसी भी ग्राहक को सर्विस करने से मना नहीं करेगा और उन्हें अच्छी व उन्नत  टू– वीलर सर्विस ब्रोसर अनुसार प्रदान करायेगा । कि प्रथमपक्ष ग्राहक से ब्रोसर में अंकित राशि है | उसी अनुसार सर्विस की राशि का 50 % (250÷2= 125 Rs.) लेगा व इंजन फ्लश का 50% (190÷2= 95 Rs.) व इंजन ऑडिटव का 50% (175÷2= 87) व पेट्रोल सप्लिमेंट्स का 50% (185÷2= 92)  राशि लेगा इसके अतिरिक्त ग्राहक से राशि वसूल नहीं करेगा
5.  कि प्रथमपक्ष द्वितीयपक्ष ग्राहक को 200 / -रुपये  से अधिक वाली लेबर पर 12 बार सर्विस में 50/ -रुपये का डिस्काउंट उपलब्ध करायेगा ।

• कि प्रथमपक्ष द्वितीयपक्ष की किसी भी सूचना व गतिविधि को किसी भी व्यक्ति व ग्राहक को साझा नहीं करेगा और ना ही अवगत करायेगा ।

• कि प्रथमपक्ष द्वितीयपक्षा के साथ व ग्राहको के साथ किसी भी प्रकार का विश्वासघात नहीं करेगा और ग्राहक के साथ किसी भी प्रकार का बुरा व्यवहार नहीं करेगा ।
• कि द्वितीयपक्ष के ग्राहक प्रथमपक्ष से किसी भी सर्विस के लिए पाबन्द नहीं रहेगे  ग्राहक अपनी इच्छा अनुसार सामान लाकर सर्विस प्रथमपक्ष से करवा सकते है ।
• कि प्रथमपक्ष द्वारा ग्राहको की बाइक सर्विस की गारंटी 10 दिन होगी और किसी भी समस्या के होने पर उसे प्रथमपक्ष पुनः सही करके देगा |
• कि प्रथमपक्ष द्वितीयपक्ष के साथ काम नहीं करना चाहेगा तो द्वितीयपक्ष को 1 माह पहले लिखित में सूचना देगा तथा द्वितीयपक्ष के ग्राहक को जिनके ब्रोसर जारी कर रखे है उन्हें 18 माह तक नियमित सर्विस उपलब्ध करायेगा एवं द्वितीयपक्ष के किसी ग्राहक की कोई शिकायत आती है तो द्वितीयपक्ष तुरन्त बिना सूचना दिये काम को समाप्त करने का अधिकार होगा ।
• यह कि इस इकरारनामें में प्रथमपक्ष के द्वारा द्वितीयपक्ष को किसी भी प्रकार की राशि प्रदान नहीं की गई  है अत प्रथमपक्ष किसी भी तरह से द्वितीयपक्ष पर राशि प्राप्त करने के लिए दबाव व वाद – विवाद उत्पन्न  नहीं करेगा ।
• कि सभी वाद – विवादो का न्याय क्षेत्र नसीराबाद और जयपुर रहेगा जिसे तय करने अधिकार Smart Mechanical Engineers की सहमति का होगा |
